AML & Prohibited Use Policy

pokz will not stand in the middle of a transaction it cannot stand behind. This policy sets out what is refused and what checks may apply.

1. Purpose

pokz operates a risk-based approach to prevent the service being used for money laundering, terrorist financing, sanctions evasion, fraud or any other unlawful purpose.

2. Prohibited transactions

The following are refused without exception:

  • Anything unlawful under Portuguese or EU law, or unlawful where either party is.
  • Stolen, counterfeit, replica or illegally obtained goods, and stolen data.
  • Weapons, ammunition, explosives and their components.
  • Drugs, controlled substances, precursors and prescription medicines.
  • Sexual services and any content involving minors.
  • Wildlife, protected species and human tissue.
  • Trading of accounts, credentials, tokens or licences in breach of a platform's terms.
  • Malware, ransomware, botnets, hacking services and stress/DDoS services.
  • Any transaction with a party, entity or jurisdiction subject to EU, UN, UK or US sanctions.
  • Any arrangement whose purpose or effect is to obscure the origin, ownership or destination of funds.

3. Restricted transactions

Higher-value transactions, transactions involving unusually structured payments, transactions where a party is unwilling to state what is being exchanged, and transactions involving third-party payers may be accepted only after additional checks, or refused.

4. Verification

pokz may request identity documentation, proof of address, proof of ownership of the goods or funds, and an explanation of the source of funds, proportionate to the risk presented. A transaction may be suspended while such a request is outstanding. Refusal to comply results in the held value being returned to its source, less costs incurred, and the room being closed.

5. Suspicious activity

Where pokz has reasonable grounds to suspect that a transaction relates to criminal activity, it may suspend or refuse the transaction, retain records, and make a report to the competent authorities. Where the law prohibits disclosure of such a report, pokz will not inform the parties of it.

6. Records

Transaction records, terms, decisions and any verification material are retained as set out in the Privacy Policy and for at least the period required by applicable law.

7. Consequences

Breach of this policy is a material breach of the Terms of Service. pokz may close rooms, refuse future business, withhold release pending instruction from a competent authority, and recover its costs.
